2. Orders, Billing & Subscriptions

2.1 One‑Time Orders

When you place a one-time purchase on thsordinary.com, you agree to pay the current price, plus any shipping and taxes. You're responsible for reviewing your order before checkout.

If you're dissatisfied, let us know within 60 days of delivery—email support@thsordinary.com or chat with us, and we'll issue a refund or replacement per our Refund Policy.

2.2 Subscription Orders

Some items are available by subscription, meaning automatic recurring deliveries and billing.

By signing up for a subscription, you agree that:

  • We (or our payment processor) may charge your payment method automatically at your chosen frequency (e.g., monthly).
  • Your subscription auto‑renews on the billing date unless canceled at least 5 days beforehand.
  • You're responsible for all charges processed before cancellation.

2.3 Failed Payments & Updates

If your payment method fails, you'll be notified and asked to update it. Subscriptions will remain active unless canceled; continued non-payment may result in suspension or cancellation at our discretion.

3. Marketing Communications & SMS Program

If you opt in to receive marketing from THS Ordinary, you may receive emails or SMS/MMS text messages with updates, offers, product launches, cart reminders, and more.

3.1 Email & SMS Consent

By subscribing to THS Ordinary marketing, you agree to receive recurring automated promotional messages at the contact information you provide. This includes emails and text messages. Consent is not required to make a purchase. Message frequency varies. Standard message and data rates may apply.

You may withdraw consent at any time:

  • Email: Click "Unsubscribe" in any marketing email.
  • SMS: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to opt out.

Your opt-in information is never sold. We may share your SMS or email opt-in status with trusted service providers solely for the delivery of marketing messages.

3.2 SMS Program Terms

This section governs your use of THS Ordinary's SMS/MMS mobile messaging services (the "Program").

User Participation By subscribing, you consent to receive marketing text messages using an automatic telephone dialing system (autodialer), where applicable. However, not all messages may be sent using such a system.

  • Opt-In: You affirmatively opt into the Program via web forms or checkout checkboxes.
  • Opt-Out: Reply with the designated STOP keywords listed above.

  • Order confirmations and shipping updates

Disclaimer & Availability Messages are provided "as is" and may not be available in all areas or on all carriers. THS Ordinary is not responsible for delays, undelivered messages, or service outages.

Cost Message and data rates may apply per your mobile provider. Message frequency varies based on interactions and campaign engagement.

Dispute Resolution In the event that there is a dispute, claim, or controversy between you and Us, or between you and any third-party service provider acting on Our behalf to transmit mobile messages as part of the Program, arising out of or relating to federal or state statutory claims, common law claims, this Agreement, or the breach, termination, enforcement, interpretation, or validity thereof — including the determination of the scope or applicability of this agreement to arbitrate — such dispute, claim, or controversy shall, to the fullest extent permitted by law, be resolved by binding arbitration in Lewes, DE before a single arbitrator.

4. Resale & Use Restrictions

All orders of Products must be for your personal use only. By purchasing Products, you hereby agree not to resell or distribute such Products for any commercial purposes. All orders are subject to our acceptance or rejection based on Product availability, noncompliance with this Agreement or any other reason as determined in our sole discretion. For instance, if we have reason to believe that your order is not for personal use, we reserve the right to reject or cancel any order that you place. We also reserve the right, in our sole discretion, to take steps to verify your identity to process your order. We will either not charge you or refund the charges for orders that we cancel or do not process.

5. Medical & Product Disclaimers

THS Ordinary shall not be held liable for the medical claims made by customer testimonials. The statements made regarding these products have not been evaluated by the Food and Drug Administration. The efficacy of these products and the testimonials made have not been confirmed by FDA-approved research. These products are not intended to diagnose, treat, cure or prevent any disease or ailment. All information presented here is not meant as a substitute for or alternative to information from health care practitioners. Please consult your healthcare professional about potential interactions or other possible complications before using any product.

6. Membership Terms and Conditions

Part of the Services may include access to a members-only offering that provides exclusive benefits for a quarterly price (the "Membership"). For more information on the Membership, including current benefits, pricing, and how to sign up, please see our Membership FAQs on our website.

6.1 Fees and Renewal

You must pay the Membership fee stated on the membership page before receiving any benefits. From time to time, we may change the fees for the Membership without notice. The Membership fee is non-refundable except as expressly set forth in these Membership Terms and Conditions. Taxes may apply and will be added to your order.

If all eligible payment methods we have on file are declined, you must provide a new eligible payment method promptly or your Membership will be canceled. If your payment is later successful, your new Membership period will be based on the original renewal date, not the date of the charge.

AUTOMATIC RENEWAL NOTICE: UNLESS YOU NOTIFY US PRIOR TO A CHARGE THAT YOU WISH TO CANCEL OR DO NOT WANT TO AUTO-RENEW, YOUR MEMBERSHIP WILL AUTOMATICALLY CONTINUE. YOU AUTHORIZE US (WITHOUT NOTICE, UNLESS REQUIRED BY LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND TAXES USING ANY ELIGIBLE PAYMENT METHOD ON FILE.

6.2 Changes to Membership Terms

We may modify the terms of our Membership program at any time. Changes will be posted on our website and are effective as of the date of posting. Your continued Membership after updates constitutes your acceptance of those changes.

6.3 Termination by Us

We may terminate your Membership at any time, at our discretion. If so, you will receive a prorated refund based on the number of full unused months. No refund will be issued for termination due to violation of these Terms, misuse, fraud, or other harmful conduct. Failure to enforce these Terms does not waive our right to do so in the future.

6.4 Store Credits

As part of your Membership, you may receive store credits. These can only be used for purchases on our website and expire 12 months after being earned or received. Unused credits after expiration will be forfeited. Store credits cannot be redeemed for cash or gift cards.

6.5 Limitation of Liability

In addition to other limitations in these terms, our total liability for your membership, whether in contract, warranty, tort (including negligence), or otherwise, will not exceed the last membership fee you paid to us. This limitation applies to the fullest extent permitted by law and survives termination or cancellation of your membership.

7. Contributions

By submitting suggestions or other feedback regarding our Services ("Contributions") in any way to THS Ordinary, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) THS Ordinary is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) THS Ordinary shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) THS Ordinary may have something similar to the Contributions already under consideration or in development; (e) you irrevocably non-exclusively license to THS Ordinary rights to exploit your Contributions; and (f) you are not entitled to any compensation or reimbursement of any kind from THS Ordinary under any circumstances.

8. Intellectual Property

You are not permitted to use these Marks without our prior written consent or the consent of such third party that may own the Marks.

9. Chat Feature

By using our chat feature, you consent to the recording and use of information about you and this chat session by THS Ordinary or any authorized service provider acting solely on THS Ordinary's behalf. THS Ordinary may use or disclose this information in accordance with its Privacy Policy. If you do not consent to these terms, please do not use this chat feature and reach out to us via email or by phone. Your continued interaction with, or submission of information to, this chat feature will be deemed to be your acceptance of THS Ordinary's Privacy Policy.

10. Lost Package Policy

If your package shows that it's been delivered at usps.com, dhl.com, ups.com, or fedex.com and you still haven't received it, no problem! Just file a claim with the appropriate carrier and provide us with the claim number via email, chat or phone call.

We are not responsible for lost or stolen items if your order has been shipped to the correct address that you provided on your order or any shipping address that you confirmed. Customers agree that THS Ordinary does not have any liability on the order once it's already been shipped. It will be in the position of the carrier and it's the responsibility of the customer to communicate with the carrier regarding the lost or stolen items.

Please note that mail theft is punishable by law and is a federal crime, a felony that could result in prison time, the loss of the right to vote or hold public office, and significant fines. The taking of items through fraud, deception, or embezzlement are included within the definition of the crime. Mail theft includes but are not limited to: Hiding or destroying mail also constitutes mail theft, as does the purchase, receipt, or possession of mail that one knows was stolen.

11. Limitation of Liability

We'll never be liable for indirect, incidental, or punitive damages. Liability is capped at the greater of the amount paid for the product/service or as limited by applicable laws.

12. Governing Law & Disputes

For U.S. users, Delaware law governs. For EU/UK users, local consumer protection laws apply. Any disputes should first be addressed in good faith; unresolved issues may be escalated to an appropriate court or arbitration as indicated above.

13. Changes to These Terms

We may revise these Terms at any time. When changes are material, we'll notify you by email or site notice. The latest version's date is at the top.
